AESTHETIC VALLEY PRIVACY POLICY

Section One - Introduction 

Thank you for visiting Aesthetic Valley (“Aesthetic Valley”). Aesthetic Valley provides an online platform through which medical services can be ordered and booked. Aesthetic Valley is committed to protecting information about its customers and maintaining policies that protect the confidentiality of personal information which may be obtained from users through transactions made from the website. This Privacy Policy describes the type of Personal Information we collect as well as our methods for using, sharing, maintaining, and protecting your information. 

Section Two - Consent 

By using the Services, you consent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services or the Aesthetic Valley Platform. Information gathered through the Services may be transferred, used, and stored in the United States or in other countries where our service providers or we are located. If you use the Services, you agree to the transfer, use, and storage of your Personal Information in those countries. 

The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You agree that all transactions relating to the Services or the Aesthetic Valley Platform are deemed to occur in the United States, where our servers are located.This Privacy Policy also does not apply to information collected from visitors who register and log-in ("Members") to the password-protected and secure portions of our Sites ("Secure Platforms"). The Secure Platforms allow eligible Members to perform certain transactions and use Aesthetic Valley's services (such as telehealth and expert medical services). 

When using our Sites, you may choose to interact with features from third parties that operate independently from Aesthetic Valley, such as social media widgets and links to third-party websites. Aesthetic Valley has no control over and is not responsible for the privacy practices of such third parties. This Privacy Policy does not apply to the extent Aesthetic Valley does not own or control any linked websites or features you visit or use. We recommend that you familiarize yourself with the privacy practices of those third parties. 

This Privacy Policy is not a contract and does not create any contractual rights or obligations. Section Three - What Type of Data We Collect 

Collectively in this Privacy Policy, Personal Data and Non-Personal Data is referenced as “Data.” When you visit the Aesthetic Valley Platform, you may provide us with certain information about you. We or our advertising partners also may automatically collect information through the use of cookies and other tracking technologies (see below). 

“Personal Data” is information that is capable of being associated with an individual through one or more identifiers including but not limited: 

a) Your name, email address, mailing address, and phone numbers;

b) Your credit card number or other identifying information related to your payment methods; 

c) Information related to any medical aesthetic procedure you may search, browse, or submit a booking request for; 

d) Identifying information derived from your activity on social media and other users you may interact with on various social media platforms. 

e) Your web browser, IP address, time zone, geolocation, web beacons (defined below), and cookies (defined below) installed in your device; 

“Non-Personal Data” is information that does not identify you, but provides insights to us regarding your use of the Services. 

a) Your Internet connections, computer equipment, web browsers, sites visited before using or accessing our Site, sites visited after leaving our Site, and other similar information about traffic and usage, as you navigate to, through, and away from our Site(s)). 

How Payments Are Collected. When you wish to make a payment to Aesthetic Valley for our Services, you may choose how you would like to do so. You have the following payment options to choose from: 

a) You may provide your payment information (i.e. credit card number, cvv number, and billing zip code) through our Site. The only payment information that we retain from you is the billing zip code, last four (4) digits of the payment card, and the card’s expiration date. 

b) You may also choose instead to be connected to another of our third-party service providers, PayPal. In this case, we neither collect nor store any payment information from you and your payment interactions are entirely through PayPal’s services. 

Section Four - How Your Data is Collected 

Generally, we collect Personal Data when you interact with the Aesthetic Valley Platform. Interactions can look like registering a user account, using any of the features available on the Aesthetic Valley Platform, or interacting with Aesthetic Valley through third-party social media sites. 

We can also collect your Data by requesting that you voluntarily complete a customer survey or provide feedback on any of our message boards, or via email. 

We may use analytic and reporting technologies to record data such as Internet domain and host names, Internet protocol (IP) addresses, browser software, operating system types, click patterns, and the dates and times that the Aesthetic Valley Platform and our services are accessed by you. 

We may be in contract with a third party to help us manage, monitor, and optimize the Aesthetic Valley Platform and measure the effectiveness of our advertising, communications, and use of the Aesthetic Valley Platform. We may use web beacons and cookies for this purpose.

Aesthetic Valley may use the following technologies to collect and track your non-personal and personal data: 

a) “Cookies”- Cookies are data files that are placed on your device or computer and often include an anonymous unique identifier. We use Cookies to collect certain types of Non-Personal Data. By using our Services, you acknowledge that we use these data collection tools and accept the terms of our Cookie Notification. You can set your browser to reject Cookies, but that may limit your use of some convenience features on the Services. b) “Log Files” – Log files track actions occurring on the Aesthetic Valley platform, and collect data including your IP address, browser type, internet service provider, referring/exit pages, date/time stamps, and geolocation. 

c) “Web Beacons”, “Tags” and “Pixels” – These are electronic files used to record information about how you browse and use the Aesthetic Valley Platform and interact with our emails. 

Section Five - How Your Data Is Used 

We do not sell or rent Personal Data to any third parties. We use information collected to store your preferences, improve website navigation, make personalized features and other services available to you, to generate statistical information, monitor and analyze user traffic and usage patterns, monitor and prevent fraud, investigate complaints and potential violations of our policies, to improve the our content and the products, services, materials, and other content that we describe or make available through the Site, and otherwise help administer and improve the Services. 

We may identify you from your Personal Data and merge or commingle Personal Data and Non-Personal Data, for any lawful business purpose. Where you provide registration information, cookies can also be used to identify you when you log onto the Services or portions of the Services. Except as otherwise stated, we may use information we collect from you for the legitimate business purpose of providing our Services to you, including, but not limited to: 

a) responding to your requests and providing user support; 

b) evaluating and improving the content of our Services; 

c) customizing the Services to your preferences; 

d) establishing accounts to use the Services; 

e) communicating information and promotional materials to you (where you have not expressed a preference otherwise); 

f) checking on your account status and maintain record of activities in connection with your use of the Site; 

g) notifying you of any changes to relevant agreements or policies; 

h) researching and analyzing information;

i) enforcing our agreements, terms, conditions, and policies; 

j) working with our service providers who perform certain business functions or services on our behalf and who are bound by contractual obligations consistent with this Privacy Policy; 

k) preventing or investigating fraud (or for risk management purposes), 

l) complying with a legal obligations, court order, or in order to exercise our legal claims or to defend against legal claims; 

m) Any other purpose with your consent. 

We may use third‐party e‐mail providers to deliver these communications to you. This is an opt-in email program. If you no longer want to receive these e-mail communications, you may opt-out of receiving email communications. 

We may, from time to time, invite you to participate in online surveys, such as a post-purchase feedback survey on your experience with our Services. The information requested in these surveys may include, but is not limited to, your opinions, beliefs, insights, ideas, activities, experience, purchase history, and purchase intent regarding products, events, and Services. We use the information collected by these surveys to research market trends, company growth, community needs, etc. Your input will help us to improve customer experience and shape development of our products and Services. 

We may anonymize or aggregate Data that we collect from the use of the Services, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access the Services, market trends, and other analysis that we create based on the information we receive from you and other users. If you provide Personal Data through our Services, we may aggregate that Data with other active Data, unless we specify otherwise at the point of collection. 

Section Six - How Aesthetic Valley Uses Your Information In Marketing 

Aesthetic Valley would like to send you information about products and services of ours that we think you might like. If you have agreed to receive marketing, you may always opt-out at a later date. You have the right at any time to stop Aesthetic Valley from contacting you for marketing purposes. If you no longer wish to be contacted for marketing purposes, please contact us by email at contact@aestheticvalley.com.

 

Section Seven - How Your Data Is Shared To Third Parties 

We will disclose your personal information to protect or enforce our legal rights and policies, to protect or enforce the legal rights of a third party, or as we in good faith believe we are required to do so by law (such as to comply with a subpoena or court order, for example). 

We may contract with various third parties who help us provide, maintain and improve the Aesthetic Valley Platform and the services and products we promote, offer, or sell now or in the future, and such third parties may have access to your personal information to perform their services.

We may also use third-party contractors to help us measure the effectiveness of our advertising and communications. We will enter into confidentiality and non-disclosure agreements with all third parties that have access to your personal information which will prohibit them from using or disclosing your personal information except to provide services to us. 

We intend to take commercially reasonable steps to enforce such non-disclosure and confidentiality agreements if and when we become aware of any violations. 

We do not sell or rent Personal Data to marketers or unaffiliated third parties. We do have relationships with trusted third parties, but we will not share any Personal Data that we have collected from or regarding you except as described below: 

As we believe necessary: (i) under applicable law; (ii) to enforce applicable terms and conditions; (iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; (iv) to detect, prevent, or otherwise address fraud, security or technical issues; (v) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment and (vi) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence; 

Section Eight - More Information Regarding Third Party Service Providers 

We use third-party service providers to help us operate our Services, who may collect, store, and/or process the information detailed herein. We allow access to our database by third parties that provide us with services, such as technical maintenance, market research, community and forums management, and personal/job search functionality, but only for the purpose of and to the extent necessary to provide those services. 

There are times when you provide information about yourself to us in areas of the Service that may be managed or participated in by third parties. In such cases, the information may be used by us and by such third party(ies), each pursuant to its own policies. We may also provide your information to our advertisers, so that they can serve ads to you that meet your needs or match your interests. 

We use commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing, and use of Non-Personal Data and Personal Data. While we may seek to require such third parties to follow appropriate privacy policies and will not authorize them to use this information except for the express purpose for which it is provided, and you agree that we do not bear any responsibility for any actions or policies of third parties. 

Section Nine - How Your Data Is Protected and Stored 

We follow generally accepted industry standards to protect personal data submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we do not guarantee absolute security. 

We are not responsible for the unauthorized acts of others and we assume no liability for any disclosure of information due to transmission errors, unauthorized third-party access (such as through hacking) or other acts of third parties, or acts or omissions beyond our reasonable control. 

Unless otherwise described or requested by you, we will retain your Data only for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. At any time, users may request deletion of their accounts by sending an email to contact@aestheticvalley.com. When you delete your account, it cannot be recovered. Please note that we do retain Non-Personal Data, including aggregated, de-identified data for the purposes described in the section titled, “How We Use Data.” 

Aesthetic Valley will keep your data on our site for as long as we necessarily require and, in any event, as long as Data Protection Legislation allows. 

Section Ten - How To Exercise Your Data Protection Rights 

If you are not satisfied with how we manage your Personal Data, you have the right to make a complaint to a data protection regulator. A list of National Data Protection Authorities can be found here. Aesthetic Valley would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following: 

a) The right to access – You have the right to request copies of your data from Aesthetic Valley. We may charge you a small fee for this service. 

b) The right to rectification – You have the right to request that Aesthetic Valley correct any information you believe is inaccurate. You also have the right to request Aesthetic Valley to complete the information you believe is incomplete. 

c) The right to erasure – You have the right to request that Aesthetic Valley erase your data, under certain conditions. 

d) The right to restrict processing – You have the right to request that Aesthetic Valley restrict the processing of your data, under certain conditions. 

e) The right to object to processing – You have the right to object to Aesthetic Valley’s processing of your data, under certain conditions. 

f) The right to data portability – You have the right to request that Aesthetic Valley transfer the data that we have collected to another organization, or directly to you, under certain conditions.

Section Eleven - Data Security 

We take reasonable steps online and offline to safeguard the Personal Data that you provide to us, including Secure Sockets Layer (SSL) encrypted connections (HTTPS) to the web site(s) on our Service(s), secure multi-tiered firewalls, and portions of your data may also be encrypted on our storage server for additional security, secure cloud-based environments and uses server authentication and industry-standard firewalls in an effort to prevent interference or access from outside intruders. We also require unique account identifiers, user names, and passwords that must be entered each time users log into their accounts or use secure password credentials to an authorized third-party portal. 

Nonetheless, it is common knowledge that transmission of information via the internet is not wholly secure, and we cannot guarantee the security of your Personal Data, or any other information, transmitted to or through any of our Service(s). Any transmission of Personal Data, or other information, is at your own risk. By using our Service(s), you acknowledge and accept these risks. As a result, we cannot guarantee or warrant the security of any information you disclose or transmit to us or that are otherwise provided to us and we cannot be responsible for the theft, destruction, or inadvertent disclosure of information. It is your responsibility to safeguard any passwords, ID numbers, or other special access features associated with your use of the Service(s). Any transmission of information is at your own risk. By using our Service(s), you acknowledge and accept these risks. 

If you have any questions about security on our Services, or if you become aware of any unauthorized use of an account, loss of your account credentials, or suspect a security breach, notify us immediately via email at contact@aestheticvalley.com. If our security system is breached, we will notify you of the breach only if and to the extent required under applicable law. 

Section Twelve - Do Not Track 

Please note that we do not alter Aesthetic Valley’s data collection or use practices when websites linked to the Privacy Policy see a Do Not Track signal from your browser.Your browser settings also may allow you to transmit a "Do Not Track" signal when you visit various websites. Some of the sites may not be configured to respond to "Do Not Track" signals received from browsers. To learn more about "Do Not Track" signals, you can visit here. 

Section Thirteen - This Privacy Policy and Your Access to Third Party Websites and Platforms 

You will be able to access third-party websites directly from the Aesthetic Valley Platform. This Privacy Policy does not apply when you access third-party websites or platforms. We cannot control how third parties may use personal data you disclose to them, so you should carefully review the privacy policy of any third-party website you visit before using it or disclosing your data to its provider. 

Section Fourteen - Children’s Privacy 

Aesthetic Valley does not intend to attract children or persons under the age of 18. We will not knowingly collect or use any personal data from children or persons that we know to be under the age of 18. In addition, we will delete any personal data in our database that we know originates from a child or person under the age of 18. 

If you are under the age of 18, you, your parent, or your legal guardian may request that we deactivate any of your data in our database and/or opt-out from receiving communications from us. If you wish to do so, please reach us at contact@aestheticvalley.com

Section Fifteen - Your California Privacy Rights 

California Civil Code Section 1798.100-199, the California Consumer Privacy Act (“CCPA”) permits certain additional responsibilities towards California Residents. Before collection of Personal Data, we will notify California residents as to the categories of Personal Data that will be collected. In the last twelve (12) months, Aesthetic Valley collected the following categories of personal information from its consumers: identifiers; personal information categories listed in the California Customer Records statute (California Civil Code Section 1798.80(e)); protected classification characteristics under California or federal law; commercial information; Internet or other similar network activity; and geolocation data. In the last twelve (12) months, Aesthetic Valley has not sold personal information. 

Aesthetic Valley has disclosed the following categories of personal information to service providers for a business purpose in the last twelve (12) months: identifiers; personal information categories listed in the California Customer Records statute (California Civil Code Section 1798.80(e)); protected classification characteristics under California or federal law; commercial information; Internet or other similar network activity; and geolocation data. Aesthetic Valley may disclose deidentified patient information, and as part of such disclosure, Aesthetic Valley uses the HIPAA safe harbor method under 45 C.F.R. § 164.514(b)(2) to de-identify such information.

 

In addition, California residents may request the list of the Personal Data and related information collected by us as denoted in California Civil Code Sections 1798.110(a) and 1798.115. A California resident may also request that we delete any Personal Data about the California resident, so long as the Personal Data is not necessary to our business or service provider functions, as denoted in California Civil Code Section 1798.105(d). California residents will not receive discriminatory treatment by us for the exercise of their privacy rights conferred by the CCPA. In addition, a California resident may designate an authorized agent to make a request under the CCPA on his or her behalf. California Civil Code Section 1798.83 permits California residents to request and obtain a list of what Personal Data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made up to twice per year and are free of charge. Under Section 1798.83, California residents are entitled to request and obtain such information, by sending an email request to contact@aestheticvalley.com

Section Sixteen - International Users 

The Sites are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Any information you provide to us through use of our Sites may be stored and processed, transferred between and accessed from the United States and other countries that may not guarantee the same level of protection of personal data as the one in which you reside. However, we will handle your Personal Information in accordance with this Privacy Policy regardless of where your Personal Information is stored/accessed. 

Section Seventeen - Updating this Privacy Policy 

We will only use your data in the manner described in this Privacy Policy. Additionally, Aesthetic Valley reserves the right at all times to modify any part of this Privacy Policy at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Aesthetic Valley Platform thereafter provided that these changes will be prospective only and not retroactive. 

Your continued use of the Aesthetic Valley Platform following the posting of the revised Privacy Policy means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. 

Any portions of this policy are void to the extent they are prohibited by applicable law.
